Welcome to ZoScan (a brand name operated by PRABHAVE TECHSMART, hereinafter referred to as "Company", "we", "our", or "us"). These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("user", "you"), and PRABHAVE TECHSMART concerning your access to and use of the ZoScan mobile application and website (collectively, the "Platform").
1. Agreement & Acceptance of Terms
By accessing, downloading, installing, or using ZoScan, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms and Conditions in compliance with the Information Technology Act, 2000, and rules made thereunder. If you do not agree with all of these terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
2. Eligibility & Account Security
The Platform is intended for users who are at least 18 years of age or competent to contract under the Indian Contract Act, 1872. By registering via WhatsApp or mobile OTP, you agree to:
- Accurate Information: Provide accurate, current, and complete registration data.
- Confidentiality: Maintain the confidentiality and security of your login credentials and OTPs.
- Account Responsibility: Be fully responsible for all activities that occur under your account.
- Security Alert: Notify us immediately of any unauthorized use or security breach.
3. Barcode Scanning & GST Calculation Services
ZoScan provides barcode lookup, live cart tracking, estimated GST breakdown, and bill reconciliation utilities. You acknowledge and agree that:
- Informational Purposes: Barcode pricing, product details, and GST calculations (0%, 5%, 12%, 18%, 28%) provided by the app are estimates derived from standard retail pricing and crowdsourced databases.
- Invoice Verification: The final printed or electronic billing invoice generated by the merchant/retail store supersedes any estimates displayed on ZoScan. We are not liable for discrepancies between store point-of-sale pricing and app estimates.
4. ZoCoins & Loyalty Rewards Program
Users may earn promotional reward points ("ZoCoins") by scanning products, uploading verified shopping bills, or completing referral milestones.
- Redemption Value: ZoCoins have no direct cash value until converted according to active redemption tiers within the app wallet.
- Fraud Prevention: Uploading fraudulent, altered, duplicate, or non-compliant bills will result in immediate forfeiture of accrued ZoCoins and permanent account suspension.
- Inactivity Expiry: Unredeemed ZoCoins may expire after 12 months of consecutive account inactivity.
5. Intellectual Property Rights
Unless otherwise indicated, the Platform is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform (the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us and are protected by copyright and trademark laws of India.
6. Limitation of Liability & Governing Law
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Platform. These Terms shall be governed by and defined following the laws of India. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana.
